The UAE Federal Authority for Identity, Citizenships, Customs and Port Security (ICP) has introduced a two-month visa amnesty period. This initiative, running from 1st September to 31st October 2024, allows expats with expired visas and overstay fines to either regularize their status or leave the country without financial penalties.
Expats who have overstayed their visas in the UAE can benefit from this amnesty scheme. It offers them a chance to either legalize their residency status or exit the country without facing fines. The process can be completed in less than 15 minutes at designated Amnesty tents in Abu Dhabi and Dubai.
UAE Visa Amnesty Scheme
The visa amnesty scheme aims to help those who have violated residency rules by providing them with an opportunity to comply with the law. Expats can either transfer to a new sponsor or leave the UAE without incurring penalties. This initiative is designed to address various issues faced by illegal residents.
Those opting to stay in the UAE must regularize their residency status. They will receive a six-month visa, allowing them time to find employment and register with the Ministry of Human Resources and Emiratization (MOHRE). Alternatively, those choosing to depart will have any penalties waived but will face a two-year entry ban.
Reasons for Violation of Residence Visa Rules
Several factors contribute to expats violating residence visa rules. Job loss is a significant reason; when expats lose their jobs, they typically have a 30-day grace period to find new employment or leave the country. However, securing new employment quickly can be challenging due to market conditions and personal constraints.
Passport expiration also complicates matters as UAE residency visas are linked to valid passports. Renewing a passport abroad can be time-consuming, especially if consular services are limited. Without a valid passport, individuals cannot renew their visas or legally exit the country.
Financial Hardship
Financial difficulties often lead to visa issues when individuals cannot afford renewal fees or fines for violations. This creates a cycle where their illegal status prevents them from working legally, worsening their financial situation. Additionally, some fall victim to scams or fraud, leading them into illegal residency situations.
Absconding cases occur when employees leave their sponsors without proper visa cancellation. This results in police cases against them, making their stay illegal and complicating future employment or exit opportunities. Reasons for absconding include workplace disputes or better job opportunities elsewhere.
Visa Overstay
Overstaying visas is another common issue requiring amnesty. Individuals may overstay due to forgetting expiry dates, misunderstanding extension processes, personal emergencies, or travel restrictions like those during the COVID-19 pandemic. Overstaying leads to hefty fines and potential re-entry bans.
The validity of residence visas in the UAE varies based on type and sponsor: tourist visas last 30 days for single entry or 90 days for multiple entries; visit visas are valid for 30 or 90 days and are extendable; work visas last 2-3 years; student visas last one year; retirement visas last five years; investor visas last three years; golden visas last 5-10 years.
Expats who fail to renew their visas before expiry must pay fines of AED 50 per day. Those wishing to renew have a six-month grace period after their original residency visa expires or is canceled.
