Up To Dh50,000 Fine: UAE Enforces Midday Break For Worker Safety Starting June 15

The UAE Ministry of Human Resources and Emiratisation (MoHRE) has recently announced the enforcement of the Midday Break rule, effective from June 15 to September 15. This regulation forbids outdoor work under direct sunlight and in open-air areas between 12:30 and 3:00 pm across the UAE. This initiative, marking its 20th consecutive year, underscores the UAE's commitment to safeguarding workers' health and safety by mitigating risks associated with high summer temperatures.

Mohsin Al Nassi, Assistant Undersecretary for Inspection Affairs at MoHRE, emphasized the integral role of the Midday Break in fortifying the health and safety of workers, regarded as invaluable assets to the corporate sector.

"Implementing the Midday Break has become a deeply ingrained culture in the UAE's business community and among private-sector companies in the country, given its role in ensuring the health and safety of workers, whom we consider to be the most valuable resource of any company," Al Nassi stated. He further expressed aspirations for ongoing collaboration among the Ministry, private enterprises, and the community to foster a competitive, efficient, and attractive labour market that prioritizes worker wellbeing.

While the Midday Break is stringent, it recognizes the necessity to maintain continuity in certain essential jobs. Exemptions apply to critical tasks such as laying asphalt, pouring concrete, and emergency repairs that directly impact the community, including water supply disruptions and significant traffic flow or basic service issues. Moreover, jobs requiring government permits for implementation during the break are also exempted.

Employers are mandated to ensure the safety of their workers during exempted periods by providing necessary protections such as shaded areas, cooling devices, adequate drinking water, hydrating materials, and first aid equipment. These measures aim to shield workers from the harsh summer conditions, ensuring their health and safety remain uncompromised.

Enforcement and Compliance

To ensure strict adherence to the Midday Break rule, MoHRE will conduct inspection tours and rely on community reports to identify violations. Non-compliant companies face significant fines, amounting to Dh5,000 for each worker found working during the prohibited hours, with a maximum penalty of Dh50,000 for multiple violations. To bolster compliance, the Ministry will engage in awareness campaigns and field visits, educating both workers and employers on the importance of observing the Midday Break.
