New Decree To Resolve Jurisdictional Conflicts Between DIFC Courts And Dubai Judicial Authorities

In a significant move aimed at streamlining judicial processes, His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President, Prime Minister and Ruler of Dubai, has enacted Decree No. (29) of 2024. This decree establishes the 'Judicial Authority for Resolving Jurisdictional Conflicts between DIFC Courts and Judicial Authorities in the Emirate of Dubai', marking a pivotal step in the evolution of Dubai's legal framework.

The decree encompasses all judicial entities within Dubai, including the Court of Cassation, the Court of Appeal, the Court of First Instance, and any future courts that may be integrated into the Judicial Authority in Dubai. It also extends its applicability to the DIFC Courts, ensuring a comprehensive coverage across the emirate's judicial landscape.

Decree Resolves DIFC-Dubai Judicial Conflicts

Under this new decree, the previously named Judicial Tribunal for Dubai Courts and DIFC Courts will undergo a name change to reflect its enhanced role and responsibilities. The rebranded 'Judicial Authority for Resolving Jurisdictional Conflicts' will operate under the leadership of the President of the Court of Cassation at Dubai Courts. The Deputy Chief Justice of DIFC Courts will serve as the Deputy Chairman, alongside other distinguished members including the Secretary General of the Dubai Judicial Council, and Presidents of both the Court of Appeal and Court of First Instance at Dubai Courts. Additionally, two judges from DIFC Courts, selected by its Chief Justice, will join the Authority.

The Authority is charged with several critical tasks, including determining the competent court for disputes and specifying enforceable judgments in cases of jurisdictional conflicts. It will also carry out duties assigned by either the Ruler of Dubai or the Chairman of the Dubai Judicial Council. Decisions made by this Authority are deemed final and are not subject to appeal.

Furthermore, legal rules established by the Judicial Authority in its decisions will serve as binding judicial principles for all courts within Dubai, including DIFC Courts. This ensures consistency and clarity in legal proceedings, with any subsequent ruling that conflicts with these principles subject to appeal through legally defined channels.

The Chairman of the Dubai Judicial Council is tasked with issuing necessary decisions to implement this decree effectively. It's important to note that this decree supersedes Decree No. (19) of 2016 concerning the Judicial Tribunal for Dubai Courts and DIFC Courts. However, decisions made under Decree No. (19) of 2016 will remain effective unless they contradict the new decree, until they are replaced by new ones.

Decree No. (29) of 2024 is set to be published in the Official Gazette and will come into effect the day after its publication. This legislative move represents a significant step towards enhancing judicial efficiency and resolving jurisdictional conflicts within Dubai's legal system.
