DIFC Courts: Consolidating Status As Region's Pre-eminent Forum For English Language Dispute Resolution
The Dubai International Financial Centre (DIFC) Courts have disclosed their annual statistics for 2023, showcasing a year of sustained growth and increased preference among global businesses, SMEs, and individuals for resolving disputes. The English-language, common law judiciary has seen its caseload become increasingly international, a trend underscored by H.H. Sheikh Maktoum bin Mohammed bin Rashid Al Maktoum, Deputy Ruler of Dubai and President of the DIFC. He highlighted the role of the DIFC Courts in fulfilling Dubai's ambition to be a leading global financial hub and a pioneer in judicial dispute resolution.
Driven by initiatives like the Dubai Economic Agenda D33 and the Dubai Digital Strategy, the DIFC Courts have experienced significant growth across various sectors. In 2023, the Court of First Instance (CFI) handled 111 cases with a total value of AED16.5 billion, averaging AED228.8 million per case. The Arbitration Division saw cases worth AED13.4 billion, with an average case value of AED955.2 million. These cases spanned sectors such as banking, finance, real estate, and manufacturing.
The Small Claims Tribunal (SCT) also recorded notable growth, with 522 cases in 2023—an increase from the previous year—valuing at AED52 million. This marks a 20% increase in total claim value and a 9% increase in average case value to AED105,000. The SCT's rising popularity reflects its effectiveness in providing accessible justice for the SME community.
Zaki Azmi, Chief Justice of the DIFC Courts, emphasized the trust placed in the judiciary to resolve a diverse array of disputes and highlighted the robust enforcement network that supports businesses. The DIFC Courts' national connectivity was further strengthened through partnerships with Dubai Chambers and Ras Al Khaimah Digital Assets Oasis (RAK DAO), enhancing support for the UAE's economic goals and digital economy services.
Justice Omar Al Mheiri noted the DIFC Courts' commitment to evolving court user needs through user-friendly procedures and efficient dispute resolution services. This approach aligns with national economic ambitions and ensures transparent access to justice.
Among ancillary services, the Wills Service registered over 1,500 Wills in 2023—a 26% increase from 2022—and saw a 21% rise in Probate applications related to Wills. This growth underscores the DIFC Courts' role in providing comprehensive legal services that meet the community's needs.
The performance of the DIFC Courts in 2023 reflects their ongoing success in offering reliable and efficient dispute resolution mechanisms. With a focus on innovation and accessibility, they continue to support Dubai's position as a global financial centre and judicial leader.
