Sheikh Mohammed Bin Rashid Issues Decree For Dubai Government Employees In Judicial Authorities

His Highness Sheikh Mohammed bin Rashid Al Maktoum, in his role as the Ruler of Dubai, has issued Decree No. (49) of 2024. This decree regulates the appointment of Dubai Government employees to judicial roles. It aims to attract national talent to Dubai's judicial authorities while protecting employees' legal status, rights, and financial benefits during training at the Dubai Judicial Institute.

The decree applies to both civilian and military employees working under government human resources regulations. These include Law No. (6) of 2012 for local military personnel and Law No. (8) of 2018 for Dubai Government employees. However, Directors General under Law No. (8) of 2013 and CEOs under Law No. (8) of 2021 are exempt from this decree.

Dubai Government Employees' New Judicial Decree

The training offered by the Dubai Judicial Institute includes the Judicial and Legal Studies Programme for judges and a Diploma in Legal and Judicial Sciences for Public Prosecutors. Employees can retain their positions within their government entities while undergoing this training.

During the training period, employees will receive their full monthly salary according to their entity's human resources rules, excluding any allowances or extra benefits. The decree also outlines conditions for granting training leave, requiring UAE nationality and fulfillment of admission criteria as per Law No. (13) of 2016 concerning judicial authorities in Dubai.

Employees must adhere to the regulations set by the Dubai Judicial Institute during their training. After completing the programme and being appointed by the Judicial Council, they must serve in a judicial authority for at least five years unless this is waived or reduced by the Council.

If an employee fails to meet this service commitment, they must repay all salaries received during their training period. The decree also specifies additional obligations set by the Judicial Council and conditions under which salary repayment is required.

Programme Completion Requirements

If an employee does not complete or meet the requirements of the training programme, they will return to their previous position within their government entity before enrolling in the programme.

This decree becomes effective upon its publication in the Official Gazette.
